{"id":22143,"date":"2023-05-19T12:08:47","date_gmt":"2023-05-19T10:08:47","guid":{"rendered":"https:\/\/fibgar.es\/consejo-de-europa-slapps-como-sintoma-del-retroceso-democratico-en-europa\/"},"modified":"2024-04-08T13:42:09","modified_gmt":"2024-04-08T11:42:09","slug":"consejo-de-europa-slapps-como-sintoma-del-retroceso-democratico-en-europa","status":"publish","type":"post","link":"https:\/\/fibgar.es\/en\/consejo-de-europa-slapps-como-sintoma-del-retroceso-democratico-en-europa\/","title":{"rendered":"Council of Europe: SLAPPs as a symptom of democratic regression in Europe\u00a0"},"content":{"rendered":"\n<p class=\"has-text-color has-link-color wp-elements-10a3915f9e82fc5f98ab15c4802d0a09 wp-block-paragraph\" style=\"color:#4a4a4a\">This week the Fourth Summit of Heads of State and Government of the Council of Europe-also known as the <strong>Council of Europe Summit<\/strong>-is taking place in Reykjavik to reinforce the Council&#8217;s key mission of safeguarding and promoting human rights, democracy and the rule of law.&nbsp;<\/p>\n\n\n\n<p class=\"has-text-color has-link-color wp-elements-452c863d9f3f2750f0c2d4c3cb9035db wp-block-paragraph\" style=\"color:#4a4a4a\">This is the fourth Council of Europe Summit since its establishment in 1949 and thus an opportunity for civil society and member countries to address the important human rights challenges highlighted by the Secretary General of the Council of Europe, Marija Pej\u010dinovi\u0107 Buri\u0107, in the <a href=\"https:\/\/rm.coe.int\/secretary-general-report-2023\/1680ab2226\" target=\"_blank\" rel=\"noreferrer noopener\">2023 Annual Report on the State of Democracy, Human Rights and the Rule of Law<\/a>&nbsp;<\/p>\n\n\n\n<p class=\"has-text-color has-link-color wp-elements-d7417fe82db984ad7581eeec90fe6b46 wp-block-paragraph\" style=\"color:#4a4a4a\">Based on the findings of the various Council of Europe bodies, including the European Court of Human Rights, the Secretary General&#8217;s report assesses strengths and <strong>weaknesses <\/strong>in areas such as political institutions and judicial independence, freedom of expression and association, human dignity, anti-discrimination and democratic participation.&nbsp;<\/p>\n\n\n\n<p class=\"has-text-color has-link-color wp-elements-621ccd5cd44c7545de14e54d9db1d128 wp-block-paragraph\" style=\"color:#4a4a4a\">The report identifies <strong>strategic lawsuits against public participation<\/strong> as an example of the current democratic backlash in Europe.&nbsp;<\/p>\n\n\n\n<p class=\"has-text-color has-link-color wp-elements-2ed385a01fbe103b37b3cf1884bb60bb wp-block-paragraph\" style=\"color:#4a4a4a\">In particular, the upward trend in the number of SLAPP suits, also highlighted in the <a href=\"https:\/\/rm.coe.int\/platform-protection-of-journalists-annual-report-2022\/1680a64fe1\" target=\"_blank\" rel=\"noreferrer noopener\">annual report of the partner organizations of the Council of Europe Platform to Promote the Protection of Journalism and Safety of Journalists (2022)<\/a>, is seen as a notable manifestation of the weaknesses of the legal framework for the protection of freedom of expression in many countries.&nbsp;<\/p>\n\n\n\n<p class=\"has-text-color has-link-color wp-elements-1e557727ddd71eb3b8a5982b0c5e6583 wp-block-paragraph\" style=\"color:#4a4a4a\">Therefore, the General Secretariat calls on countries to review their legal frameworks and redouble their efforts to implement the Court&#8217;s judgments adequately.&nbsp;<\/p>\n\n\n\n<p class=\"has-text-color has-link-color wp-elements-32007e065b9b070c19ab4430780c7451 wp-block-paragraph\" style=\"color:#4a4a4a\">The <a href=\"https:\/\/www.coe.int\/en\/web\/commissioner\/-\/time-to-take-action-against-slapps\" target=\"_blank\" rel=\"noreferrer noopener\">Council of Europe&#8217;s Commissioner for Human Rights<\/a> raised the alarm on SLAPPs already in 2020, followed by an alert from the <a href=\"https:\/\/rm.coe.int\/native\/0900001680a4a958\" target=\"_blank\" rel=\"noreferrer noopener\">General Secretariat<\/a> in 2021. Furthermore, in 2022, the European Court of Human Rights referred to SLAPPs in its judgment in the case of <strong>OOO Memo v. Russia<\/strong>, holding that a defamation case brought by a public authority against journalists did not pursue any legitimate aim. In addition, in 2022 the Committee of Ministers set up the Committee of Experts on Strategic Lawsuits against Public Participation, composed of representatives of member states and independent experts, to work on a <strong>recommendation <\/strong>to be finalized by the end of 2023.&nbsp;<\/p>\n\n\n\n<p class=\"has-text-color has-link-color wp-elements-14878715cd23ccff470d5cf501b42c4e wp-block-paragraph\" style=\"color:#4a4a4a\">The annual report serves as a warning of the dangers of democratic backsliding but highlights the need for collective action to defend democracy, human rights and the rule of law.&nbsp;<\/p>\n\n\n\n<p class=\"has-text-color has-link-color wp-elements-227d118e66eb69f3a4d91450e0248650 wp-block-paragraph\" style=\"color:#4a4a4a\">Not surprisingly, the General Secretariat also underscores the growing demand for judges, prosecutors and lawyers to be trained especially in ethics.
