{"id":22174,"date":"2023-08-30T08:34:14","date_gmt":"2023-08-30T06:34:14","guid":{"rendered":"https:\/\/fibgar.es\/dia-internacional-de-las-victimas-de-la-tortura-2\/"},"modified":"2024-04-08T13:16:21","modified_gmt":"2024-04-08T11:16:21","slug":"dia-internacional-de-las-victimas-de-la-tortura-2","status":"publish","type":"post","link":"https:\/\/fibgar.es\/en\/dia-internacional-de-las-victimas-de-la-tortura-2\/","title":{"rendered":"International Day of the Victims of Torture\u00a0"},"content":{"rendered":"\n<p class=\"has-text-color has-link-color wp-elements-70a6ae5af43c6bd2040d54128b44ceff\" style=\"color:#4a4a4a\">Since 1997, <strong>June 26 <\/strong>has been the United Nations International Day in Support of Victims of Torture and commemorates the <strong>entry into force in 1987<\/strong> of the <a href=\"https:\/\/www.ohchr.org\/es\/instruments-mechanisms\/instruments\/convention-against-torture-and-other-cruel-inhuman-or-degrading\" target=\"_blank\" rel=\"noreferrer noopener\"><strong>United Nations Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment<\/strong><\/a><strong> <\/strong>(hereinafter referred to as the Convention).&nbsp;<\/p>\n\n\n\n<p class=\"has-text-color has-link-color wp-elements-cbc9446c6f267da6c8c56d05d30f59fb\" style=\"color:#4a4a4a\">Although the Convention is a <strong>milestone <\/strong>in the fight against the international crime of torture, the <strong>first international public rejection<\/strong> of torture and other cruel, inhuman or degrading treatment was made in the <a href=\"https:\/\/www.un.org\/es\/about-us\/universal-declaration-of-human-rights\" target=\"_blank\" rel=\"noreferrer noopener\"><strong>Universal Declaration of Human Rights<\/strong><\/a>, which was adopted in 1948 by the United Nations General Assembly. Likewise, the United Nations Commission on Human Rights appointed in 1985 the S<strong>pecial Rapporteur on torture and other cruel, inhuman or degrading treatment or punishment<\/strong> to report <strong>on the situation of the crime of torture<\/strong> at the international level. <strong>Currently<\/strong>, this position as i<strong>ndependent expert<\/strong> is held by Swiss Professor <strong>Nils Melzer<\/strong>.&nbsp;<\/p>\n\n\n\n<p class=\"has-text-color has-link-color wp-elements-f380ee0cf2e705e4954c4afcaca3adc8\" style=\"color:#4a4a4a\">The Convention, which provides a <strong>definition <\/strong>of the crime of <strong>torture <\/strong>in <strong>Article 1<\/strong>, defines torture as &#8220;<em>any act by which severe <\/em><strong><em>pain or suffering<\/em><\/strong><em>, whether <\/em><strong><em>physical or mental<\/em><\/strong><em>, is <\/em><strong><em>intentionally inflicted<\/em><\/strong><em> on a person for such purposes as obtaining from him or a third person i<\/em><strong><em>nformation or a confession<\/em><\/strong><em>, to <\/em><strong><em>punish <\/em><\/strong><em>him for an act he or she has committed or is suspected of having committed, or to <\/em><strong><em>intimidate or coerce<\/em><\/strong><em> him or her or others, or for any reason based on <\/em><strong><em>discrimination <\/em><\/strong><em>of any kind, when such pain or suffering is inflicted by a <\/em><strong><em>public official<\/em><\/strong><em> or other person acting in an official capacity (&#8230;<\/em>)&#8221; (Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment).&nbsp;<\/p>\n\n\n\n<p class=\"has-text-color has-link-color wp-elements-bdba47cc95166cafbdad08b522000932\" style=\"color:#4a4a4a\">Thus, one of the fundamental <strong>characteristics <\/strong>of the crime of torture is that it must be committed by a specific person, namely, a <strong>public official in the exercise of his or her functions<\/strong>. It is also essential to mention that the Convention provides for the creation of the <strong>Committee against Torture<\/strong>, an <strong>independent body<\/strong> made up of 10 <strong>experts<\/strong>, which is responsible for the proper <strong>implementation of the Convention<\/strong> by the States parties, for <strong>consultations <\/strong>and for considering individual and inter-<strong>State complaints<\/strong>.&nbsp;<\/p>\n\n\n\n<p class=\"has-text-color has-link-color wp-elements-77b8af8764918beafa9f6086ebff5aa0\" style=\"color:#4a4a4a\">Finally, and in this regard, it is essential to remember that the crime of torture is considered a form of the <strong>crime against humanity<\/strong>; thus, the latter is one of the international crimes set forth in the <a href=\"https:\/\/www.un.org\/spanish\/law\/icc\/statute\/spanish\/rome_statute(s).pdf\" target=\"_blank\" rel=\"noreferrer noopener\">Rome Statute of the International Criminal Court<\/a> (1998). Consequently, as a crime against humanity falls within the material jurisdiction of the International Criminal Court, it may <strong>hear and prosecute<\/strong> acts of torture if they are committed in the context of a <strong>widespread or systematic attack against a civilian population<\/strong>.&nbsp;<\/p>\n\n\n\n<p class=\"has-text-color has-link-color wp-elements-614da50546c12064fd638b7d329d8f54\" style=\"color:#4a4a4a\">In Spain, the National <a href=\"https:\/\/www.defensordelpueblo.es\/mnp\/defensor-mnp\/\" target=\"_blank\" rel=\"noreferrer noopener\">Mechanism for the Prevention<\/a> of Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment, a function delegated to the Ombudsman, was approved in 2009. In 2015, the then Coordinator for the Prevention of Torture, compiled a total of 6,621 complaints of police ill-treatment or torture in Spain, although, the sentences issued by the courts in this matter are substantially lower. In this regard, the European Court of Human Rights has condemned Spain on up to six occasions for not having sufficiently investigated the aforementioned complaints, and the European Committee for the Prevention of Torture has even reprimanded the State for not investigating them.&nbsp;<\/p>\n\n\n\n<p class=\"has-text-color has-link-color wp-elements-e1740c61d3ad95a0eb3c219077c46db7\" style=\"color:#4a4a4a\">Although all the legal instruments mentioned so far are essential in the fight against torture, <strong>measures for the prevention<\/strong> of this crime should not be overlooked, as well as <strong>specialized programs for rapid recovery from torture, aimed at the rehabilitation and healing of victims<\/strong>.
