{"id":22670,"date":"2023-12-09T08:00:00","date_gmt":"2023-12-09T07:00:00","guid":{"rendered":"https:\/\/fibgar.es\/dia-internacional-contra-la-corrupcion-veinte-anos-de-lucha\/"},"modified":"2024-02-27T12:07:50","modified_gmt":"2024-02-27T11:07:50","slug":"dia-internacional-contra-la-corrupcion-veinte-anos-de-lucha","status":"publish","type":"post","link":"https:\/\/fibgar.es\/en\/dia-internacional-contra-la-corrupcion-veinte-anos-de-lucha\/","title":{"rendered":"International Anti-Corruption Day: Twenty Years of Fighting Back"},"content":{"rendered":"\n<p class=\"has-text-color has-link-color wp-elements-e8324a42934addc9aeb27c0fd7e8042e wp-block-paragraph\" style=\"color:#4a4a4a\"><em>&#8220;Corruption is an insidious plague [&#8230;] It undermines democracy and the rule of law, leads to human rights violations, distorts markets, erodes the quality of life and allows organized crime, terrorism and other threats to human security to flourish.&#8221;<\/em><\/p>\n\n\n\n<p class=\"has-text-color has-link-color wp-elements-5b63a633b7c7e96600ce77440fe5acc7 wp-block-paragraph\" style=\"color:#4a4a4a\">So begins the Preamble to the <strong>United Nations Convention against Corruption (UNCAC)<\/strong>, adopted by the General Assembly in its resolution 58\/4 of 31 October 2003 and entered into force on 14 December 2005.<\/p>\n\n\n\n<p class=\"has-text-color has-link-color wp-elements-8acb566d899e98716d3330cd902b3476 wp-block-paragraph\" style=\"color:#4a4a4a\">The UNCAC, which establishes a global legal framework to prevent, detect and punish corruption and promote international cooperation, represents the first legally binding instrument in this field, <strong>widely ratified <\/strong>by 190 member states, with only three countries remaining outside: the Syrian Arab Republic, Eritrea and North Korea.<\/p>\n\n\n\n<p class=\"has-text-color has-link-color wp-elements-f436d150da366a8945447f59d7273f13 wp-block-paragraph\" style=\"color:#4a4a4a\">This framework introduces a comprehensive set of rules, measures and regulations that can be applied by all countries to strengthen their legal and regulatory regimes to combat corruption and is based on the four fundamental pillars of prevention, criminalization and law enforcement, international cooperation and asset recovery.<\/p>\n\n\n\n<p class=\"has-text-color has-link-color wp-elements-7bebec38ed6653e448c9b3b1b81f4736 wp-block-paragraph\" style=\"color:#4a4a4a\">In addition, by virtue of resolution 3\/1 of 13 November 2009 of the Conference of the States Parties to the United Nations Convention against Corruption, this framework also has a <strong>&#8220;Mechanism for the Review of Implementation of the Convention&#8221;<\/strong> (MEA), a three-stage process overseen by an open-ended intergovernmental group of States Parties known as the Implementation Review Group (IRG).<\/p>\n\n\n\n<p class=\"has-text-color has-link-color wp-elements-d5471c74471ea13a393f5f5bc17e0cac wp-block-paragraph\" style=\"color:#4a4a4a\">Spain, which ratified the Convention in 2006, has been subject to review on two occasions. The <strong>first<\/strong> wasin 2011, during the first review cycle (2010-2015) dedicated to criminalization and law enforcement and Chapter IV on international cooperation. The<strong> second <\/strong>in May of this year in the framework of the second review cycle dedicated to the analysis of the implementation of Preventive Measures, and Policies and Practices for the Prevention of Corruption, and Asset Recovery. The report of this visit will be published in 2024.<\/p>\n\n\n\n<p class=\"has-text-color has-link-color wp-elements-f0e3513b2cc512536198e6bb7ba4083d wp-block-paragraph\" style=\"color:#4a4a4a\">Meanwhile, it is worth noting that Spain has dropped two consecutive years in the <strong>Corruption Perceptions Index (CPI)<\/strong> published by Transparency International Spain. Its score in 2022 was 60\/100. Even so, according to the organization &#8220;this reflects that a level of factors that affect the proper functioning of democratic institutions and raise the risk of corruption remains latent&#8221;.
