The date aims to reinforce Europe\u2019s commitment to the fight against impunity and highlight the need to ensure investigations and judicial proceedings into some of the most serious crimes under international law.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">However, in the current context, the commemoration raises an unavoidable question: to what extent are international justice mechanisms actually being protected against growing political and geopolitical pressures?<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This is no minor question. International justice is facing one of its most complex periods in recent decades. Alongside the persistence of armed conflicts, mass atrocities and serious human rights violations, there are growing difficulties in ensuring independent investigations, executing international arrest warrants and securing effective mechanisms for judicial cooperation between states.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">At the same time, international judicial institutions, human rights defenders and multilateral organisations face campaigns of political pressure, financial restrictions and attacks aimed at discrediting them or limiting their ability to act.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>International cooperation and the fight against impunity<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The creation of the EU Day Against Impunity was a direct response to the need to strengthen international judicial cooperation and consolidate mechanisms capable of combating international crimes at national and regional levels.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In recent years, the European Union has promoted key tools to strengthen coordination between European prosecutors and judicial authorities, particularly through mechanisms such as Joint Investigation Teams (JITs), the Genocide Network and the European Judicial Network. Likewise, the European Union\u2019s Global Human Rights Sanctions Regime has expanded Europe\u2019s capacity to respond to serious human rights violations through restrictive measures&nbsp;&nbsp; targeting individuals and entities responsible for international abuses.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">However, the current international context also highlights the limits of these advances. Growing geopolitical fragmentation, the weakening of multilateral consensus and the difficulties in ensuring compliance with international law have exposed the fragility of many accountability mechanisms. In various contexts, international investigations continue to depend on minimal levels of political cooperation that are now increasingly difficult to sustain.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>The centrality of victims in accountability processes<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">One of the main themes of this commemoration has historically been the need to place victims and survivors at the centre of international justice processes.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In this regard, the recent review of the Victims\u2019 Rights Directive (Directive 2012\/29\/EU), aimed at strengthening guarantees of protection, assistance and participation for victims within the European Union, is particularly significant.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The process reflects a growing institutional awareness of the specific needs faced by victims of mass atrocities, particularly in relation to access to psychosocial support, protection mechanisms, translation services and effective participation in complex judicial proceedings.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But the challenge remains much broader. In many contexts, victims continue to face enormous obstacles in accessing justice, participating safely in international investigations, or accessing effective mechanisms for reparation. The slowness of proceedings, budgetary constraints and political difficulties in advancing certain investigations continue to directly affect those seeking truth, justice and reparation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>International judicial independence under threat<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">One of the most worrying aspects of the current situation is the growing level of political pressure directed against international judicial institutions and actors involved in investigations into international crimes.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Sanctions, financial restrictions and smear campaigns directed against judges, prosecutors, international experts and multilateral mechanisms now represent a direct threat to international judicial independence.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The situation of the International Criminal Court (ICC) is one of the most visible examples of these tensions. In recent years, officials and authorities involved in investigations relating to Palestine and Gaza have faced intense pressure and sanctions from the United States.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Similarly, the United Nations Special Rapporteur on the Occupied Palestinian Territories, Francesca Albanese, has been the target of political attacks and pressure campaigns due to her reports on the situation in Gaza.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In this context, the Spanish Government recently requested the European Commission to activate the so-called EU Blocking Statute, a mechanism designed to prevent certain extraterritorial sanctions adopted by third states from taking effect within the European Union.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The debate is particularly significant because it highlights a central issue: without judicial independence, the fight against impunity loses much of its real capacity for action.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>What does defending international justice mean today?<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The commemoration of the EU Day Against Impunity is now much more than a symbolic date on the European calendar.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In an international landscape marked by multiple conflicts, growing geopolitical tensions and a progressive weakening of the multilateral consensus, the defence of international justice mechanisms has also become a political dispute over the validity of international law and the capacity of international institutions to act in the face of abuses of power.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The fight against impunity requires strengthening national and international judicial capacities, preserving cooperation between states, and protecting those who investigate, document and report serious human rights violations. But it also demands something more fundamental: the political will to uphold the independence of international mechanisms even when investigations affect powerful actors. Because when political pressure succeeds in influencing the work of international justice, it is not only the institutions that are weakened.
