According to the Austrian Public Prosecutor\u2019s Office, both are alleged to have ordered or permitted the systematic mistreatment of detainees in detention centres in Raqqa.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The case represents one of the most significant proceedings opened to date in Austria under the principle of universal jurisdiction and joins other cases brought in countries such as Germany, France, Sweden and the United Kingdom against former members of the Syrian state apparatus. These national proceedings have become fundamental tools in combating impunity for international crimes committed during the Syrian conflict.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In addition to its relevance for ensuring accountability for abuses committed in Syria, the proceedings opened in Vienna could establish an important precedent regarding the incorporation of a gender-based approach in the prosecution of international crimes under universal jurisdiction. The inclusion of charges relating to sexual coercion and sexual violence within the framework of state repression demonstrates a progressive broadening of investigations into the various forms of violence perpetrated by the regime.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Universal jurisdiction in Austria<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Austrian framework for universal jurisdiction has developed gradually and relatively late compared to other European countries. Although Austria was at the forefront of one of the first European trials relating to crimes committed in the former Yugoslavia with the Dusko Cvjetkovic case in 1994\u20131995, it was not until the<strong> 2015 reform of the Criminal Code<\/strong>, in force since January 2016, that it fully incorporated the international crimes set out in the Rome Statute into its domestic legal system. This reform consolidated the ability of Austrian courts to investigate and prosecute some of the most serious violations of international law, reinforcing the country\u2019s alignment with its obligations in the field of international criminal justice.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Currently, Chapter 25 of the Strafgesetzbuch (StGB) criminalises genocide, crimes against humanity, war crimes and the crime of aggression. In turn, Article 64 of the Criminal Code lays the foundations for Austrian jurisdiction, allowing national courts to exercise jurisdiction over certain offences committed outside the national territory, irrespective of the law applicable at the place of commission. The cases covered include, in addition to various serious offences under Austrian criminal law, the international crimes incorporated into domestic law in compliance with the Rome Statute.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">However, the Austrian model does not constitute absolute universal jurisdiction. For the courts to exercise jurisdiction over international crimes committed abroad, there must be some link to Austria. Such a link may arise from the Austrian nationality of the victim or the alleged perpetrator, the impact on Austrian national interests, or the presence or habitual residence of the suspect on Austrian territory.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&nbsp;In this regard, the Federal Ministry of Justice has noted that even certain refugee flows generated by the commission of international crimes may be considered an infringement of national interests, potentially broadening the scope of jurisdiction of the national courts.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The presence of the suspect in Austria constitutes, in practice, one of the main enabling criteria for the opening of investigations and judicial proceedings. Furthermore, the Austrian system incorporates elements of the aut dedere aut iudicare principle (\u201cextradite or prosecute\u201d), which allows national authorities to exercise jurisdiction when a person accused of certain international crimes is present on Austrian territory and cannot be extradited. Furthermore, the legislation provides for the possibility of exercising jurisdiction over other offences where Austria has an international obligation to prosecute them under international treaties.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">However, Austrian universal jurisdiction continues to face significant limitations. The legal system does not permit trials in absentia during the oral proceedings, which restricts the possibility of trying persons who are not under the effective jurisdiction of the State. Added to this are institutional and operational challenges, including the lack of specialised structures dedicated exclusively to the investigation of international crimes and the evidentiary difficulties inherent in acts committed in contexts of armed conflict or state repression thousands of kilometres away.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Despite these obstacles, the full incorporation of international crimes into domestic law, the presence of a significant Syrian diaspora in Austria, and the growing experience accumulated by the judicial authorities have facilitated the recent development of investigations linked to the Syrian conflict. In this context, Austria has become one of the European jurisdictions which, although operating under a more restrictive model than other countries in the region, continues to contribute to international efforts to ensure accountability for international crimes.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>The trial of Khaled al-Halabi and Musab Abu Rukbah<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The trial underway in Vienna has as its main defendants former Brigadier General Khaled al-Halabi and former Lieutenant Colonel Musab Abu Rukbah, who held senior positions within the Syrian security apparatus in the province of Raqqa between 2011 and 2013. According to the indictment, both are alleged to have participated in acts of torture and ill-treatment against at least 21 people detained during the crackdown on civil protests that began in Syria in 2011.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Austrian Public Prosecutor\u2019s Office maintains that the defendants ordered, facilitated or failed to prevent acts of physical and psychological violence committed in detention centres under their authority. The charges include torture, grievous bodily harm, aggravated coercion and sexual coercion. If found guilty, both face sentences of up to ten years\u2019 imprisonment. The trial is scheduled to run for thirteen days of hearings until the end of June and will feature testimony from alleged victims and witnesses residing both in Syria and in various European countries. Furthermore, during the preliminary hearings, victims and survivors of the Syrian repressive regime had already given evidence, including Muhammad Jamal Arabi, a Syrian-Austrian citizen who claimed to have been detained and tortured in 2012 for providing medical and logistical support to opposition figures.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Khaled al-Halabi, regarded by activists and human rights organisations as one of the highest-ranking Syrian officials linked to abuses who was in Europe, has been in pre-trial detention since 2024. Both he and Abu Rukbah applied for asylum in Austria in 2015 and have resided in the country ever since. Both pleaded not guilty at the start of the proceedings on the first day of the trial, which took place on 1 June.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The case has also been surrounded by significant political and institutional controversy. Various journalistic and judicial investigations have suggested that Austrian officials facilitated Al-Halabi\u2019s arrival and stay in Austria following his departure from Syria. According to the allegations, the transfer involved the Israeli Mossad as part of an operation reportedly known as \u201cWhite Milk\u201d. Although the Austrian officials investigated for these acts were eventually acquitted in 2023, the case sparked a debate about the risk of Europe becoming a safe haven for those allegedly responsible for international crimes.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The investigation was also supported by international and human rights organisations, which provided documentation and legal support to the victims. The Commission for International Justice and Accountability (CIJA) had already informed the Austrian authorities of Al-Halabi\u2019s alleged crimes in 2016; organisations such as the European Centre for Constitutional and Human Rights (ECCHR), Amnesty International and CEHRI are also supporting the proceedings.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Conclusions<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The trial that has begun in Vienna is a further example of the growing role played by European national courts in prosecuting international crimes through the principle of universal jurisdiction. Given the impossibility of accessing effective mechanisms of justice in Syria, this type of proceeding has become a fundamental avenue for victims and survivors seeking truth, justice and reparation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The case also highlights both the possibilities and the limitations of the Austrian model of universal jurisdiction. Although Austria has had a fully aligned legal framework since 2016 that enables the exercise of universal jurisdiction, significant institutional obstacles remain, including the absence of specialised structures and restrictions arising from the requirement for a territorial or personal link to the country.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">At the same time, the proceedings against Al-Halabi and Abu Rukbah demonstrate how cooperation between victims, human rights organisations and national judicial authorities can enable the building of complex cases even years after the events took place.
