It strips the victim of liberty while simultaneously erasing them from the protection of the law, denying any information about their whereabouts or fate. That is why it is considered a continuing crime: as long as the fate of the disappeared person remains unknown, the crime keeps being committed every single day and never lapses. This year marks twenty years since the UN General Assembly adopted, in December 2006, the International Convention for the Protection of All Persons from Enforced Disappearance, the instrument that for the first time classified this crime as an autonomous offense.

On 15 September 2026, as part of the 63rd session of the Human Rights Council in Geneva, the interactive dialogue took place with the Working Group on Enforced or Involuntary Disappearances, the longest-standing international mechanism dedicated to this issue, active since 1980. More than forty state delegations, national human rights institutions, and civil society organizations spoke during the session, painting a troubling picture of a phenomenon that, far from receding, keeps spreading and adapting to new contexts: armed conflict, migration, organized crime, and, increasingly, transnational repression aimed at silencing exiled activists and journalists.

This year’s thematic report focused on the relationship between enforced disappearance and memorialization the set of policies, archives, and symbolic practices aimed at preserving victims’ memory on which the Working Group had previously launched a call for contributions. Countries such as Peru, Guatemala, Morocco, Chile, and Indonesia presented their own memory policies during the debate, linked to transitional justice processes. Yet the Working Group’s own chair insisted on a crucial distinction: memorialization can never substitute for the active search for disappeared persons, criminal investigation, or effective reparation. It must be led by families and receive state support without interference an especially sensitive issue in occupied or actively contested territories, as Ukraine, Azerbaijan, and Croatia recalled, the latter still searching for 1,725 people missing since the war of the 1990s.

The figures presented during the session are staggering. Since its creation, the Working Group has recorded more than 65,000 cases across dozens of countries, and currently estimates more than 50,000 active, unresolved cases in 99 states. Mexico acknowledged identifying more than 22,000 people previously considered disappeared between 2023 and 2026, although organizations such as Peace Brigades International place the country’s total figure above 130,000 disappeared persons a crisis of such magnitude that it led the Committee on Enforced Disappearances to activate, for the first time, the Article 34 procedure to refer the case to the General Assembly. In Sudan, enforced disappearance has become a weapon of war used by militias, with more than 15,000 documented cases, many involving women and girls. In Ukraine, nearly 16,000 civilians are listed as missing since the Russian invasion, while concerns grow over the systematic deportation of Ukrainian children. In Gaza, the Palestinian delegation and several organizations put the number of disappeared persons at more than 11,000 since October 2023, half of them women and children, in a context they described as part of a genocidal pattern.

The dialogue also revealed the persistent lack of cooperation from certain states. North Korea flatly rejected the report’s findings, while China accused the Working Group of relying on false information; both countries questioned the mandate’s impartiality. Tanzania rejected the findings on the post-election violence of October 2025. In response, the chair was clear: a state’s silence is never a defense, and credible, unrebutted allegations are taken as established. Individual cases also marked the session: the six women’s organization workers disappeared by the Taliban in Kabul just last month, and Japan’s persistent demand to clarify the abduction of Japanese nationals by North Korea, an issue that has dragged on for decades.

Compounding this political resistance is a structural problem: the UN’s ongoing liquidity crisis is directly limiting the Working Group’s capacity to conduct country visits and provide technical cooperation, a concern raised by several states and by the chair herself, who explicitly called for voluntary contributions.

It is worth remembering that this debate in Geneva is only one piece of a much broader legal framework, and that the fight against enforced disappearance is not waged solely at the Human Rights Council. The Rome Statute of the International Criminal Court classifies enforced disappearance as a crime against humanity when committed as part of a widespread or systematic attack, and at the regional level the 1994 Inter-American Convention on Forced Disappearance of Persons remains a key jurisprudential reference through the Inter-American Court of Human Rights. Ratification of these instruments, however, remains far from universal, and numerous states with high levels of enforced disappearance have still not incorporated the crime into their domestic criminal law, perpetuating impunity.

Twenty years after the Convention’s adoption, enforced disappearance remains one of the human rights violations with the deepest structural impunity. Ending it requires what no international mechanism can impose on its own: genuine political will from states, adequate resources for the bodies tasked with investigating and supporting families, and meaningful participation of victims at every stage of the process. As the Working Group’s chair reminded delegates when closing the debate, behind every case file is a family still waiting for an answer: a wife in Ukraine, a mother in Gaza, a brother in Pakistan. Giving them that answer ultimately depends on states choosing to cooperate.

Article by Annalisa Losapio, FIBGAR’s collaborator.

Of all serious human rights violations, enforced disappearance may be the cruelest in its mechanics: it leaves no body, no grave, no certainty.
