Trials cannot try everyone. Archives are incomplete or deliberately destroyed. Perpetrators die, flee, or are protected by the very institutions meant to hold them accountable. Out of that impasse, over the last half-century, the international community has built a body of principles known as transitional justice: the idea that societies recovering from conflict or authoritarian rule owe their victims four interlocking things <strong>truth, justice, reparation and guarantees of non-recurrence<\/strong>. None of the four is optional or a substitute for the others. A truth commission without prosecutions is memory without accountability. Prosecutions without reparation leave survivors formally vindicated but materially unassisted. And none of it holds if nothing changes to prevent recurrence.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The right to a remedy is not a recent invention. It is anchored in Article 8 of the <a href=\"https:\/\/www.ohchr.org\/en\/universal-declaration-of-human-rights\">Universal Declaration of Human Rights<\/a>, which guarantees everyone \u201can effective remedy\u201d for acts violating their fundamental rights, and it was given systematic legal shape in 2005, when the UN General Assembly adopted the <strong>Basic Principles and Guidelines on the Right to a Remedy and Reparation for Victims of Gross Violations of International Human Rights Law and Serious Violations of International Humanitarian Law<\/strong> (<a href=\"https:\/\/www.ohchr.org\/en\/instruments-mechanisms\/instruments\/basic-principles-and-guidelines-right-remedy-and-reparation\">resolution 60\/147<\/a>). That document set out, for the first time in a single instrument, what reparation actually means in practice: restitution, compensation, rehabilitation, satisfaction and guarantees of non-repetition categories that continue to structure how the Human Rights Council, its Special Procedures and national mechanisms approach the aftermath of atrocity today.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Since 2011, the Human Rights Council has maintained a dedicated mandate to keep this framework current: the <strong>Special Rapporteur on the promotion of truth, justice, reparation and guarantees of non-recurrence<\/strong>, created by Council <a href=\"https:\/\/docs.un.org\/en\/A\/HRC\/RES\/18\/7\">resolution 18\/7<\/a> and renewed most recently through <a href=\"https:\/\/docs.un.org\/en\/A\/HRC\/RES\/54\/8\">resolution 54\/8<\/a>. Successive mandate holders have used the position to document what works and what doesn&#8217;t across dozens of countries. Their thematic reports have covered gender approaches to transitional justice, the documentation of massive human rights violations, and in the <a href=\"https:\/\/www.ohchr.org\/en\/documents\/thematic-reports\/ahrc6325-denialism-negationism-and-revisionism-serious-violations-human\">most recent report presented to the Council the growing threat of denialism, negationist and revisionism<\/a>: the deliberate effort, increasingly amplified by social media and artificial intelligence, to replace established accounts of past atrocities with narratives serving narrow political interests. The report&#8217;s warning was pointed but not new in substance: denial does not simply distort history; it actively re-victimizes survivors and dismantles, one pillar at a time, whatever truth, justice and reparation processes had already achieved. It also flagged a subtler danger that memory or security laws adopted ostensibly to combat denial can themselves become tools of censorship if not narrowly and carefully drafted.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The stakes of getting this wrong are rarely abstract. Recent sessions of the Council have heard, almost in parallel, how the absence of truth, justice and reparation plays out for two groups who are consistently the least protected and the most affected by conflict: women and children. <a href=\"https:\/\/www.ohchr.org\/sites\/default\/files\/documents\/hrbodies\/hrcouncil\/sessions-regular\/session63\/advance-versions\/a-hrc-63-55-aev.pdf\">A recent High Commissioner&#8217;s report to the Council<\/a> found that women and children accounted for roughly 70 per cent of civilian fatalities recorded in 2023, that verified grave violations against children rose by 25 per cent year on year, and that conflict-related sexual violence \u2014 one of the crimes historically hardest to prosecute and hardest to repair nearly doubled between 2024 and 2025. The report&#8217;s recommendations track the same architecture states have committed to for two decades: remove the amnesties and statutes of limitation that shield perpetrators; make justice physically and financially accessible, as gender-responsive mobile courts have done in the Democratic Republic of the Congo; fund reparation programmes that are comprehensive rather than symbolic, as Iraq&#8217;s Yazidi Survivors Law attempts to do; and recognize categories of victim children formerly associated with armed groups, children born of conflict-related sexual violence&nbsp; that older frameworks tended to overlook.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">What emerges from decades of Council practice is a consistent, almost mechanical pattern of failure. It is rarely the absence of legal standards that blocks victims from truth, justice and reparation. States have signed the treaties, adopted the resolutions, and in many cases legislated the reparation schemes on paper. The failure is one of implementation: underfunded truth commissions, amnesty laws that survive despite being incompatible with international law, reparation funds that exist in statute but not in budget, and&nbsp; as <a href=\"https:\/\/webtv.un.org\/en\/asset\/k1a\/k1aazmv02z\">the Marshall Islands put it starkly before the Council<\/a>, referring to decades of unacknowledged harm from nuclear testing on its territory a form of denial that \u201caccepts the suffering while denying what that suffering implies,\u201d treating a settlement as an act of assistance rather than of legal responsibility.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This is not solely a Human Rights Council story. The <strong>International Criminal Court<\/strong>, the <strong>Inter-American Court of Human Rights<\/strong>, regional truth commissions from Sierra Leone to Colombia to Morocco, and a growing body of domestic jurisprudence all draw on the same underlying architecture. What the Council adds is a permanent forum where states are required, at least once a year, to explain publicly what they have and have not done and where victims&#8217; organizations, national human rights institutions and civil society can put uncomfortable facts on the record even when governments would rather they went unspoken.
