The balance of immunity and impunity in the prosecution of international crimes

It is a reality that immunities have played an important role in the international legal order. This study analyses the progressive development of international law with regard to this paradox, starting from the premise that it is of paramount importance to stop the perpetuation of state-sponsored crimes by concealing the perpetrators under a veil of immunity and impunity.

The prosecution of Judge Baltasor Garzón for his investigations into the commission of crimes against humanity during the Franco dictatorship has caused controversy in what has been perceived as an attack on the rule of law by the judge’s defence. It projects a framework for understanding the situation with the defence of the Rule of Law in Spain, through the interpretation of the obligations arising in the field of international human rights law.
